By accessing or using MindFlex ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms apply to all users of the App, including without limitation users who are browsers, customers, merchants, and contributors of content.
MindFlex is an educational quiz application that provides interactive challenges across multiple categories including Mathematics, Literacy, General Knowledge, and Brain Teasers. The App offers various difficulty levels and tracks user progress, scores, and achievements.
To access certain features of the App, you may be required to create an account. You agree to:
All content, features, and functionality of the App, including but not limited to questions, answers, text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of MindFlex and its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
MindFlex owns all rights to the questions and their answers contained within the App. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the App without prior written consent from MindFlex.

Subscription fees are charged in advance on a monthly or annual basis. All subscription fees are non-refundable except as required by law. You may cancel your subscription at any time through your account settings or through the App Store/Google Play Store.
While the App primarily provides educational content, you are responsible for your conduct while using the App. You agree not to use the App to violate any laws, infringe on the rights of others, or engage in any harmful, threatening, or abusive behavior.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MINDFLEX MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS.
IN NO EVENT SHALL MINDFLEX, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
The App is intended for users who are at least 6 years of age. If you are under 6, you may not use the App. If you are between 6 and 18 years of age, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.
Parents and guardians are responsible for supervising their children's use of the App and ensuring they understand and comply with these Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MindFlex operates, without regard to its conflict of law provisions.
